Terms & Conditions

The following Contract Terms and Conditions apply to all transportation and hauling services performed by Yellow Truck Moving:

SECTION 1: General Authorization and Packing Responsibility
The customer (hereafter referred to as "Shipper") hereby gives Yellow Truck Moving permission to handle and transport all uncrated mirrors, marble, glass tops, lamps, lamp shades, mattresses, TVs, stereos, speakers, loose items not boxed, and other unpacked fragile items. Shipper understands and agrees that if packing is required and performed by Yellow Truck Moving, the Shipper must pay for these services.

Yellow Truck Moving is not responsible for cracking, peeling, chipping, or breaking of items not packed by its employees. Additionally, the company is not responsible for the working condition of electronic items such as TVs, refrigerators, washers, dryers, and other appliances. Yellow Truck Moving does not transport live plants, tanks, or chemical containers. Furthermore, the company is not liable for the condition of the contents of cartons not packed by its employees.

SECTION 2: Difficult Access
The Shipper acknowledges that attempting to move furniture into areas with difficult access (e.g., narrow doorways, stairwells, or sharp turns) may pose risks. Yellow Truck Moving is not responsible for any damage to furniture or property (e.g., walls, floors, floor coverings) resulting from such challenging conditions. The Shipper assumes all risks associated with these circumstances.

SECTION 3: High-Value and Personal Items
Yellow Truck Moving is not responsible for loss or damage to items such as currency, jewelry, watches, deeds, securities, or precious stones unless explicitly declared prior to shipment. High-value items exceeding $1,000 must also be declared, packed appropriately, and listed on the Bill of Lading with signatures from both parties.

SECTION 4: Deposit Policy
When an appointment is scheduled, the Shipper releases their paid deposit for services to Yellow Truck Moving. The deposit is non-refundable if the moving or hauling appointment is canceled or postponed within 14 days of the scheduled date.

SECTION 5: Limitations of Liability
Yellow Truck Moving is liable for loss or damage due to negligence while handling goods, except in the following cases:

• Goods damaged due to defects, inherent flaws, or atmospheric conditions (e.g., humidity or temperature changes).
• Goods not padded or shrink-wrapped at the Shipper's request.
• Goods impacted by external factors such as Acts of God, terrorism, labor strikes, or government actions.

The maximum liability is limited to $0.30/lbs per pound per article for any lost or damaged item unless additional coverage is purchased through a third party, such as MovingInsurance.com.

SECTION 6: Delays and Unforeseen Circumstances
Yellow Truck Moving is not responsible for delays caused by traffic, road conditions, mechanical breakdowns, or other uncontrollable events. While the company strives to adhere to schedules, only reasonable dispatch is guaranteed.

SECTION 7: Storage and Abandoned Goods
If delivery cannot be made due to Shipper's failure to provide access or accept delivery, Yellow Truck Moving reserves the right to store goods at the Shipper’s expense. Unclaimed goods after 15 days will be subject to sale or disposal as outlined in the Bill of Lading.

SECTION 8: Claims Process
Claims for loss or damage must be filed in writing within 30 days of delivery or, in cases of non-delivery, within 9 months of the scheduled delivery date. Legal action must commence within 2 years and 1 day of a claim denial notice.

SECTION 9: Payment Terms
All payments for services are due upon delivery. Accepted payment methods include cash, Visa, or MasterCard. Balances must be paid in full before goods are released. A late fee of 1.5% per month (18% annual rate) applies to unpaid balances.

SECTION 10: Ownership of Goods
The Shipper warrants that they have legal ownership of all goods described in the Bill of Lading. The Shipper agrees to indemnify Yellow Truck Moving against any claims from third parties regarding ownership or possession of the goods.

SECTION 11: Governing Law and Venue
This agreement is governed by the laws of Illinois. Any legal disputes must be filed in the courts of DuPage County, Illinois.

SECTION 12: Attorney’s Fees
If litigation arises and Yellow Truck Moving prevails, the Shipper agrees to pay reasonable attorney’s fees and court costs incurred by the company.

SECTION 13: Amendments and Entire Agreement
This agreement constitutes the entire contract between Yellow Truck Moving and the Shipper. Amendments must be signed by an authorized representative of Yellow Truck Moving to be valid.

SECTION 14: SMS Terms and Conditions

1- SMS Consent Communication:
The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

2- Types of SMS Communications:
If you have consented to receive text messages from Yellow Truck Moving, you may receive messages related to the following:

• Appointment reminders
• Follow-up messages

Example:"Hello, this is a friendly reminder of your upcoming appointment with Yellow Truck Moving at Lisle, Illinois 60532 on Jan 25th at 10:00 AM. Reply STOP to opt out of SMS messaging at any time."

3- Message Frequency:
Message frequency may vary depending on the type of communication. For example, you may receive SMS messages per week.
Example:
"Message frequency may vary. You may receive up to 2 SMS messages per week regarding your appointments or account status."4- Potential Fees for SMS Messaging:
Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.

5- Opt-In Method:
You may opt-in to receive SMS messages from Yellow Truck Moving in the following ways:

6- Opt-Out Method:
You can opt out of receiving SMS messages at any time. To do so, simply reply "STOP" to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.
